Treatment clients referred from the court for substance abuse rehabilitation are most commonly referred because they are being granted a chance to try their hand at rehabilitation in lieu of jail time, other charges, fines, etc. While this is most common among first time offenders, it can occur at any point including while the defendant is being held in jail. There are various types of rehab programs that offenders might be referred to, and it usually depends on which programs are attainable in Red Level and the type of substance the person requires treatment for.
There are recovery programs that work exclusively with the courts to treat this explicit type of clientele, and are usually publicly-funded or are offered at little or no cost to the client. Additionally, there are also private drug rehab facilities that can be authorized by the court if there is a specific type of rehabilitation that the client requires or desires that a different program can't fulfill. The defendant's attorney can present such options to the judge for approval. There are even drug recovery centers that operate out of the jails and prisons themselves, whereas clients are typically in a better position for early release or other leniencies when participating in drug rehabilitation services while serving their sentence for a drug offense or a DUI/DWI.
