Clients referred from the court for drug or alcohol treatment are most commonly referred because they are being given a chance to receive rehab instead of jail time, other charges, fines, etc. While this is more prevalent with first time offenders, it can occur at any time including while someone is already incarcerated. There are various types of rehab programs that offenders can be referred to, and it usually depends on what is available in Oscar and the type of issues the person requires treatment for.
There are programs that work exclusively with the criminal justice court system to administer to this explicit type of clientele, and are usually state funded or are available at little or no cost to the client. There are also private substance abuse rehabilitation centers that can be accepted by the court if there is a specific type of rehabilitation that the client requires or desires that a different facility can't provide. The defendant's legal representation can present such alternatives to the judge for permission. There are even substance abuse treatment centers that operate out of the correctional facilities themselves, in which case clients are sometimes in a better position for reduced sentences or other leniencies when engaging in addiction treatment services while serving their sentence for a drug offense or a DUI/DWI.
